SharkCash Terms Of Service

By signing up and actively using the SharkCash program you agree to all terms and conditions set forth in this agreement. SharkCash may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with SharkCash. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the SharkCash program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Affiliates:
You must be 18 years of age or older to participate in this program. Our program is open to affiliates from Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom & United States and is void where prohibited by local governing laws.

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing SharkCash account.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.
You are solely responsible for any and all use of your SharkCash account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by SharkCash be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up with SharkCash. You agree to receive e-mail advertising from SharkCash limited to no more than 200 per day.

In the event your e-mail account on file becomes closed or blocked to messages from SharkCash, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

Keywords/Interests:
We have several "Bad" keywords/interest, (I cheat, I don't understand english etc) this assists us in finding the members that can not understand english. If your account is found to have one of these keywords/interests selected your account will be suspended.

Cheat Links:
Our advertisers are paying for you to read their ads that they have purchased. In order for us to have a good honest site and members, knowing they are reading there ads and emails, we must include Cheat Links. These are found in emails and on the site itself and have a negative value. You will have them say Don't click this link, Delete this ad, etc to be warned not to read these. This is to insure that we have members understanding english and NOT blind clicking. Once you are caught clicking the Cheat Links more than 3 times, your account will be Deleted. There are no second chances and you will lose all of your earnings and referrals.

Upgrades:
Affiliates may upgrade at anytime, but are not required to upgrade. We will not force affiliates to upgrade in order to get paid. When ever you choose to upgrade you understand that upgrades are non refundable, even if we decide to close the site or change the upgrades! Every upgrade has monthly ads and free referral rotation. Monthly ads will not be carried over to the next month! It is your own responsibility to submit your monthly ads on time!
The Baby Shark Upgrade is free for 1 year for the first 500 members. You must be a member for 30 days before you can request the Baby Shark Upgrade! If you don't met this requirement you will never get this upgrade!
To keep the Baby Shark upgrade you must click a minimum of 50 Paid Links per month! That is not hard, but once you fail you loss the upgrade and will not get it back!

Affiliate Pages:
All Affiliates may purchase an Affiliate Page if they like to have on. You will get 16 ads with your affiliate page, 10 sponsor links, 5 PTC's and 1 rotating banner. The sponsor links may only be a Site Name and Link. The rotating banner will rotate with other affiliate pages banners only. Affiliate pages may be promoted every where including PTP rotators, there are no Tiers! Affiliate Pages are non Refundable! If your account is deleted your affiliate page will also be deleted.
To get paid from your Affiliate Page earnings you must be active in the PTR by clicking a minimum of 50 Paid links per month! That is not hard, but once you fail you will donate 50% of your Affiliate Page earnings to SharkCash!

Vacation Mode:
When you put your account on vacation you also need to take it off when you come back. Accounts that are on vacation or inactive do not get payouts requested or randomly. If you plan on being away over 30 days then you need to contact us and let me know so that your account will be flagged and it does not get deleted. Any account that has been set on vacation for 30 days will be deleted if it is not activated within 7 days after those 30 days have passed.

Paid To Promote Feature:
Paid To Promote is an additional feature to the PTR for Upgraded Members only! Still you must be active in the PTR to use the PTP feature. If you are caught abusing the PTP your PTP will be suspended and your account is at risk of deletion. You may NOT just run the PTP link and cashout!
You must have at least 10% Personal earnings vs. $1 PTP earnings in order to be paid.
Personal Earnings are limited to Paid To Click earnings, Paid eMail earnings and earnings won in the PTC Contest!
So if you have $1.00 in PTP earnings you must have at least 10 cents in Personal earnings.

If you request payout and have not met the 10% requirement
1st time you will only be paid 10% of your PTP earnings at time of payout and donate the other 90% to SharkCash.
2nd time you will donate all your PTP earnings to SharkCash and will be suspended for PTP for 3 months!
3rd time you will not get paid and loss your account! Including all earnings, referrals, upgrade & Affiliate Page (if you had them)!

Affiliate Page Earnings, Referral Earnings and Monthly Activity Contest Earnings are not Personal earnings!!!

It is each member's responsibility to check our approved sites list prior to advertising their PTP Links. If the site you wish to advertise with is not on our approved list, contact us with the exact URL of the website in and we will check and add it if the site is sustainable.

We also recommend that you check your PTP statistics often. If your link receives too much proxy or invalid traffic, your link will automatically be suspended by the system. Once your link receives 15% or more in invalid traffic, the system will AUTOMATICALLY suspend your PTP Link. It is the member's responsibility to monitor their link and avoid link suspension!

SharkCash Policy against Inactivity and Cheating:
If you not clicked a Paid link for more the 30 days, you will be considered inactive, this is for all members.
If you have the free upgrade or an affiliate page you must click a minimum of 50 Paid Links per month to stay active!
Inactive members will be suspended daily. Free and Upgraded!
If you selected one of the "bad" keywords/interests you will be suspended!
If you have not selected the keyword/interest "Agree to Terms" you will be suspended.

Any account with incomplete or false information will be suspended. This includes Country Cheaters!
Accounts that share a computer or ISP will be deleted!! Accounts with the same payment processor ID will be deleted!!! In short, All accounts that have anything shared with an other member of SharkCash will be deleted, This effects all accounts!! You are not allowed to have Multiple Accounts, this is Cheating!!

If you are caught using any kind of "Cheating" software or link grabbing software, you will be deleted!!
Clicking cheat links is Cheating, if you have clicked 3 cheat links you will be deleted!
We do not allow members to sell their accounts or upgraded ads. Members caught selling their accounts without permission will be deleted immediately.

Every member that is suspended, free and upgraded, have 7 days the time to contact us, if you don't contact us your account will be deleted at the 8th day of suspension and you will loss all your earnings, referrals, Affiliate Page and Upgrade (if you had one) This can not be turned back!
SharkCash will not restore any account that is deleted for the above reasons!! SharkCash has a "Deleted Members" if you can't login go there and search for your username, you than will find the reason why your account is been deleted!! Support Tickets with questions about your account while it is listed on the "Deleted Members" page will not be answered!
SharkCash has the right to delete your account at our sisters sites if you are found the be cheating!

Advertising Policy:
SharkCash does not accept advertising for: Gambling, pyramid schemes, ponzi's, multi level marketing, matrixes, get-rich-quick plans, hyip, forex, drugs or drug paraphernalia, pharmacies, tobacco, adult sites and programs, obscene or sexually oriented goods or services, violations of intellectual property rights, illegal activities, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

SharkCash does not accept advertising for goods or services not mentioned above that are prohibited in PayPal Acceptable Use Policy (AUP), advertising for non legal charities, advertising pleading for or demanding money, traffic or a purchase, advertising that ridicules or humiliates others.

For security reasons SharkCash does not accept javascript ads and advertised websites may not contain CPABet, Free20, Neoffic, DoBizWith, LuckPTP, Doono or similar running invisible 0-iframes and activeX ads.

To save our members in joining a scam site SharkCash will reject all ads for sites that have a mail value of 5c per mail or have a payout above $100. This does not include Redeem Only sites!

Relationship of the Parties:
You and SharkCash are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and SharkCash. You understand that you do not have authority to make or accept any offers or make any representations on behalf of SharkCash. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
SharkCash will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or SharkCash program, even if SharkCash has been advised of the possibility of such damages. Furthermore, SharkCash aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by SharkCash. Affiliates may earn by referring new affiliates to the SharkCash program. Affiliates will earn a percentage of advertising revenues collected by SharkCash.

SharkCash will pay affiliates when their balance reaches the minimum payout rate set by SharkCash. ($1.00) Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.
Under no circumstances may your earnings exceed $10. Once you reach $10 in earnings you will be paid to the account on file. SharkCash is not a savings account and wants to keep site debt as low as possible.
You will only be paid once your account is in "good shape" meaning all fields are filled with real details, no abcd or ggggff in any field! SharkCash double check your account once you have requested payout, if your account is not in "good shape" you will not get paid. You have 7 days to change your info and request payment again. Otherwise your account will be deleted!

If you use the PTP feature you must have 10% in personal earnings when you request payment!!

You will not get paid if you have not selected the interest "Agree to Terms"

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with SharkCash and may result in legal prosecution. SharkCash strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. SharkCash may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. SharkCash will file charges for recovery of any earnings received from multiple sign-ups.
